Terms of Service

Scale2Mint is a WhatsApp-based Communications Platform as a Service (CPaaS) operated by Aashirvanta Innovations Pvt. Ltd., a company incorporated under the laws of India ("Company", "we", "us", "our"). The platform is accessible at scale2mint.com and app.scale2mint.com.

Scale2Mint enables businesses to send bulk WhatsApp campaigns, manage customer conversations, build automated chat flows, and integrate WhatsApp messaging into their business processes via the WhatsApp Business Platform by Meta.

To use Scale2Mint, you must:

• Be at least 18 years of age
• Be a registered business or represent a registered business entity
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Accept and comply with WhatsApp's Business Policy and applicable Meta terms

You are responsible for all activity that occurs under your account. Notify us immediately at hello@scale2mint.com if you suspect unauthorised access to your account.

Scale2Mint is built on the WhatsApp Business Platform. Your use of Scale2Mint is subject to and must comply with:

• WhatsApp Business Policy
• WhatsApp Terms of Service
• Meta Platform Terms

You acknowledge that Meta may suspend or terminate access to the WhatsApp Business Platform independently of any action by Scale2Mint. We are not liable for any disruption caused by Meta's enforcement of its own policies.

You may use Scale2Mint solely for lawful business communication purposes. Specifically, you agree to:

• Only send messages to recipients who have explicitly opted in to receive messages from your business
• Use only Meta-approved message templates for marketing communications
• Clearly identify your business in all messages
• Provide a clear and easy opt-out mechanism to all recipients
• Honour all opt-out requests immediately and permanently
• Comply with all applicable Indian laws including the Information Technology Act 2000, TRAI regulations, and any applicable data protection legislation

You must not use Scale2Mint to:

• Send spam, unsolicited messages, or messages to individuals who have not opted in
• Distribute false, misleading, deceptive, or fraudulent content
• Send content that is illegal, abusive, hateful, defamatory, or violates the rights of others
• Promote gambling, adult content, tobacco, alcohol, or other regulated goods in violation of applicable law
• Impersonate any person, business, or entity
• Attempt to circumvent, hack, or interfere with our platform or Meta's infrastructure
• Resell or sublicense access to Scale2Mint without our prior written consent
• Use the platform for political campaigning without prior disclosure and approval
• Upload contact lists obtained through unlawful means or without proper consent

Violation of these prohibitions may result in immediate account suspension or termination, and may be reported to relevant authorities.

6.1 Credit-Based System

Scale2Mint operates on a prepaid credit system. Credits are purchased in advance and consumed as messages are sent. Pricing per message depends on the message template category (marketing, utility, authentication) and is displayed in your account dashboard.

6.2 Subscription Plans

Subscription plans provide access to platform features. Subscriptions are billed monthly and renew automatically unless cancelled before the renewal date.

6.3 Refunds

Unused credits are non-refundable except at our sole discretion or where required by applicable law. Credits consumed for messages that failed due to a verified platform error (not recipient-side rejection) will be refunded to your account automatically.

6.4 Taxes

All prices are exclusive of applicable taxes. GST will be charged as applicable under Indian tax law.

All rights, title, and interest in Scale2Mint — including the platform, software, design, branding, and documentation — are owned by Aashirvanta Innovations Pvt. Ltd. or its licensors. Nothing in these Terms grants you ownership of or licence to our intellectual property beyond the limited right to use the platform as described herein.

You retain full ownership of all content you upload or create through Scale2Mint, including your message templates, contact data, and campaign configurations. By using the platform, you grant us a limited licence to store and process this content solely to provide the service.

Our collection, use, and handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that your use of Scale2Mint and your collection of customer data complies with all applicable privacy laws.

We aim to maintain platform availability of 99.5% measured monthly, excluding scheduled maintenance windows. Scheduled maintenance will be communicated at least 24 hours in advance where possible. We are not liable for downtime caused by third-party infrastructure providers, Meta's platform, or events outside our reasonable control.

To the maximum extent permitted by applicable law:

• Scale2Mint is provided "as is" without warranty of any kind, express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
• Our total liability to you for any claim arising from these Terms or your use of Scale2Mint shall not exceed the amount you paid us in the three months preceding the claim
• We are not responsible for the actions of Meta, WhatsApp, or any third-party service provider

You agree to indemnify, defend, and hold harmless Aashirvanta Innovations Pvt. Ltd., its directors, employees, and agents from any claims, liabilities, damages, fines, or expenses (including legal fees) arising from:

• Your use of Scale2Mint in violation of these Terms
• Your violation of any applicable law or regulation
• Any content you transmit through the platform
• Your infringement of any third-party rights

Either party may terminate the agreement at any time. You may close your account by contacting us at hello@scale2mint.com. We may suspend or terminate your account immediately without notice if:

• You violate these Terms or WhatsApp's policies
• We are required to do so by Meta or applicable law
• Continued operation of your account poses a risk to our platform or other users

Upon termination, your access to the platform ceases. Data retention post-termination is governed by our Privacy Policy.

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Scale2Mint shall be subject to the exclusive jurisdiction of the courts in India. We encourage you to first contact us at hello@scale2mint.com to resolve any disputes informally before initiating formal proceedings.

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the platform at least 14 days before changes take effect. Your continued use of Scale2Mint after the effective date constitutes acceptance of the updated Terms.
